3.11 Affirmative Action Policy Statement
Helena School District No. 1 follows a policy of equal employment opportunity. As stated in Section 49-3-201, M.C.A., "...supervisory personnel shall recruit, appoint, assign, train, evaluate, and promote personnel on the basis of merit and qualifications without regard to race, color, religious creed, political ideas, sex, age, marital status, physical or mental handicap, or national origin ..." unless a bona fide occupational qualification exists.
Further, the District shall (a) promulgate written directives to carry out this policy and to guarantee equal employment opportunities at all levels, (b) regularly review its personnel practices to assure compliance, and (c) conduct continuing orientation and training programs with emphasis on human relations and fair employment practices.
The District shall ensure that the entire employment process including qualifications appraisal is free from bias. Appointing authorities shall exercise care to ensure utilization of persons of minority groups.
As provided in Section 49-3-205, M.C.A., District policy requires that no District facilities "...may be used in the furtherance of any discriminatory practice, nor may a ...(school district) become a party to an agreement, arrangement, or plan which has the effect of sanctioning discriminatory practices."
Additionally, Section 49-3-207, M.C.A., provides that the District shall ensure that, "Every state or local contract or subcontract for construction of public buildings or for other public work or for goods and services shall contain a provision that all hiring must be on the basis of merit and qualifications and a provision that there shall be no discrimination on the basis of race, color, religion, creed, political ideas, sex, age, marital status, physical or mental handicap, or national origin by the persons performing the contract."
Helena School District No. 1 endorses this policy and accepts responsibility for its implementation by directing the staff to follow its provisions when transacting business.
This policy statement shall be distributed to all supervisors and displayed in all schools and administrative offices.
The Board intends to comply with Title VII of the Civil Rights Act of 1964 (as amended), the Montana Human Rights Act of 1974 (as amended) the Fair Practices Act of 1975, the Americans with Disabilities Act, the Age Discrimination in Employment Act, Section 504 of the Vocational Rehabilitation Act, Title IX of the Educational Amendments Act and any other applicable federal act. The Board expects all employees and administrators to actively and affirmatively participate in the advancement of this goal.
